 Springview LandscapingLLC -VS- Grasse Development LLC Case DISMISSED!

In an anticipated ruling by Court Commissioner Christopher C. Paquet in Brown County Circuit Court, a frivolous law suit brought by Springview Landscape LLC against Grasse Development LLC, in an attempt to collect additional money on top of work left unfinished, was dismissed with prejudice on July 8, 2007. The plaintiff (Springview) was not able to provide any evidence whatsoever of any additional funds owed, nor could they prove claims that the work done was done timely and correctly. Grasse Development LLC's counter suit filed in conjunction to attempt to collect for damages done and work left undone was also, unfortunately, dismissed. Attorney Jacob Short of Gerbers Law Firm represented Grasse Development throughout the entire process. Time to move on...  

 Excavation Contractor Costs Gary Allen Grasse Estates Thousands.

 It's unfortunate that in today's current economic state, some contractors still do not have the best interest of their clients in mind. The best way to do business and to obtain economic stability is to under promise and over deliver. This was not the case with Springview Landscaping and Ed Gersek Inc.(click on Simple Search tab, enter business name, click Search) the excavation contractors who were hired to build the road for Gary Allen Grasse Estates. Poor communication, unpredictable timetables, incompetence on the job and several renegotiations while work was in progress were all red flags that meant trouble was on its way. Work was left unfinished, or done incorrectly, costing thousands to correct and finish. To add insult to injury, Ed Gersek Inc. is over charging in excess of $7,000.00 for the work they did perform. These bad business practices not only disrupted construction on the neighborhood's first home, but also casts a shadow over the entire project. As a result, road construction has stopped for the year. We are working hard to overcome this obstacle and are confident we will be back on track soon. Meanwhile, lots are still available for sale and with a successful closing; road construction will resume to provide access to your lot. (Using a more qualified contractor, carefully screened and background checked.)

 Construction has begun on the first house on Gary Allen Grasse Estates. The house is 3 bedroom, 2 bath, 3 stall garage, just under 1900 sq ft with an exposed lower level which leaves the option to add another 1000 sq ft of living space. Road Construction Resumes

 Road construction resumes after a long winter and a very wet spring. Construction of the half mile road which runs perpendicular and North to County Road I began late 2007 after permits, storm water plans, biological studies and multiple survey studies were aquired and completed. The early and long winter haulted the construction project until conditions were right to continue. June 1, construction continued on the road which will service all 8 lots of Gary Allen Grasse Estates. The new road will allow access to lot 1 for the first house of the subdivision to be built. Pictures can be viewed HERE.

There are many advantages to "country living" that you may overlook when considering where to build your next house. Construction Permits Issued! Road Construction Can Begin.We met with the town of Stiles Monday night (10/22) and received final approval of the subdivision plans. The DNR and town of Stiles have issued our permits to begin construction!!! (View it by clicking HERE) The Plat map for the subdivision has been finalized and we are collecting signatures from all the owners to have it recorded. Preparation for road construction has begun. The process should take 3 to 5 weeks depending on the weather. Once the road is in up to final grade we will be able to transfer ownership of the lots to buyers. (The time to buy is NOW! Rates have dropped again and contractors are looking for work.)

Road Construction Begins!! Phase 1

Work officially begins on road construction. The excavation crew will clear trees, stumps, and top soil to prep the ground for the new road and to install utilities.

Road Construction Permits Issued!!

Permits are in!! Assuming the crew will be ready to go on Monday we should be able to break ground. The next step is to strip the roadway area of trees, stumps and topsoil.

 
 September 2007 DNR needs further data. They now need further soil data and an agreement regarding ditch maintainance. The town of Stiles has agreed to maintain the ditches along the road way and will provide the DNR with a written statement of this. Previous soil evaluation data taken earlier this year has been re submitted.
  August 2007 DNR requested biological survey is complete and none of the species were found to be on the project site. However, it is possibly a suitable habitat for these animals so extra care is needed to not disturb them. Should they be found.
 August 2007 DNR requires further review of the project site due to the possibility of endangered species that may live in that area. A wildlife biology firm has been hired to conduct the survey on the site for the Bald Eagle, Wood Turtle and the Blanding's Turtle.
 July 2007DNR has recieved the Storm Water Management plan for review and approval. Pending approval, permits will be granted and construction can begin on the road. 
 June 2007 DNR requests a Storm Water Managaement plan which is now in the process of being developed.
 May 21, 2007County Planning Commision / Town Board review

There will be some minor changes to the road design that need to be reviewed by the county planning commission and the town board before plans can be finalized. A meeting will be held at 7 pm at the town hall. The public is welcome.

Roadway Marking / Survey

There are 3 basic phases to road construction. Phase 1 incldes marking the roadway area with yet more pink flags. We will need to clear a path 66 feet (plus 12 feet for utilities) wide by 2300 feet long (length of the road).

 February  2007  DNR Robert Rosenberger meets with Hary Smith and Scott Grasse on the project site to discuss any issues that office would have regarding the development of the land. No issues other than wetland issues are discussed.

Preliminary Plat Map Delivered
Harry "Jess" Smith of Northeast Surveyors designs and delivers the Preliminary Plat Map which will be used to impliment the creation of the subdivision. The plan consists of eight lots with a size of 3 acres or more and a road
